Terms of Service

1. Acceptance of Terms
By downloading, installing, accessing, or using FitMind ("the App" or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.
These Terms constitute a legally binding agreement between you and FitMind. We may update these Terms from time to time, and your continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Eligibility and Age Restrictions
You must be at least 13 years old (or 16 years old in the European Union) to use FitMind. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these age requirements.
3. Account Registration and Security
To use certain features of FitMind, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your password and account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with others
You are solely responsible for maintaining the confidentiality of your account. We are not liable for any loss or damage arising from your failure to protect your account information.
4. Subscription Terms and Auto-Renewal
4.1 Subscription Plans
FitMind offers the following subscription plans:
- Premium Monthly: £9.99 per month
- Premium Yearly: £99.99 per year (saves 17%)
- 1 Year Plan: £99.99 for one year
4.2 Free Trial
Premium subscriptions include a 3-day free trial period. During the trial:
- You have full access to Premium features
- No charges will be made during the trial period
- Your subscription will automatically convert to a paid subscription at the end of the trial unless cancelled
4.3 Auto-Renewal (IMPORTANT - APP STORE REQUIREMENT)
Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Subscriptions automatically renew at the end of each billing period (monthly or yearly)
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- The renewal cost will be the same as the initial subscription price
- You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase
- You can also manage subscriptions in your device Settings → [Your Name] → Subscriptions
4.4 Cancellation
You may cancel your subscription at any time:
- Cancel through your Apple ID account settings in the App Store
- Go to Settings → [Your Name] → Subscriptions → FitMind → Cancel Subscription
- Cancellation takes effect at the end of the current billing period
- You will continue to have access to Premium features until the end of the paid period
- No refunds are provided for the unused portion of the current billing period
4.5 Refund Policy
Refund requests are handled by Apple in accordance with Apple's refund policy:
- You may request a refund through Apple's standard refund process
- Refunds are typically available within 14 days of purchase for initial subscriptions
- Refunds for auto-renewal charges may be available if requested promptly
- To request a refund, contact Apple Support or visit reportaproblem.apple.com
- We do not process refunds directly - all refunds are handled through Apple
4.6 Price Changes
We reserve the right to change subscription prices. If we increase prices:
- We will notify you at least 30 days in advance
- The new price will apply to your next billing cycle
- You may cancel your subscription before the price change takes effect
5. Use License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to use FitMind for personal, non-commercial purposes. Under this license, you may NOT:
- Modify, copy, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright, trademark, or proprietary notices
- Use the App for any commercial purpose without our written permission
- Share your account with others or create multiple accounts
- Use automated systems (bots, scrapers) to access the Service
- Interfere with or disrupt the Service or servers
- Violate any applicable laws or regulations
6. Health and Medical Disclaimer
IMPORTANT: FitMind is not a medical service, healthcare provider, or medical device. The workouts, fitness advice, and information provided are for informational and educational purposes only.
- Always consult with a qualified healthcare provider before starting any new fitness program
- If you have any medical conditions, injuries, or health concerns, seek medical advice before using the App
- Stop exercising immediately if you experience pain, dizziness, shortness of breath, or any other concerning symptoms
- We are not responsible for any injuries or health issues that may result from using the App
- The App does not provide medical diagnosis, treatment, or advice
- Do not use the App as a substitute for professional medical advice
7. User Content and Conduct
You are responsible for any content you submit, post, or display through the Service. You agree not to:
- Post content that is illegal, harmful, threatening, abusive, or offensive
- Impersonate any person or entity
- Violate any third-party rights (copyright, trademark, privacy, etc.)
- Upload viruses, malware, or malicious code
- Spam, harass, or harm other users
We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of users who violate these Terms.
8. Intellectual Property
The Service, including all content, features, functionality, design, logos, and trademarks, is owned by FitMind and protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written consent.
9. Account Termination
We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for:
- Violation of these Terms
- Fraudulent, illegal, or harmful activity
- Non-payment of subscription fees
- Extended periods of inactivity
You may terminate your account at any time by deleting the App and canceling your subscription. Upon termination, your right to use the Service will immediately cease.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE CLAIM
- WE ARE NOT RESPONSIBLE FOR ANY INJURIES, HEALTH ISSUES, OR DAMAGES RESULTING FROM USE OF THE SERVICE
11. Indemnification
You agree to indemnify, defend, and hold harmless FitMind and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
12. Dispute Resolution
For users in the European Union: If you are a consumer, you may bring proceedings in the courts of your country of residence.
For other users: Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable laws, except where prohibited by law.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending an email notification (for significant changes)
- Displaying a notice in the App
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription.
